由于云计算采用虚拟化技术和分布式存储，用户的数据可能存放在世界各地，数据所在国有权审查存放在本国的数据。美国是中国主要的云服务商聚集地，根据美国的《爱国者法案》，中国企业如果使用的是购买于美国云计算服务提供商的服务或者位于美国地区的服务器，美国执法者可以检查企业的数据，而不需企业的允许。企业的数据安全和商业秘密得不到有效的保障。
